Can I get my money back from a bank transfer if I was scammed?

Yes, in many cases you can. UK banking rules require Banks to refund scam victims, but this depends on when the scam happened, how the money was transferred, and whether the Bank believes you acted with “gross negligence.” Even if your Bank has refused you, you may still be eligible for a refund through the Financial Ombudsman.

How do I report and request a refund after an APP scam?

Yes, you can get your money back from an Authorised Push Payment (APP) scam — where you’ve been tricked into authorising a transfer from your bank account via the Faster Payment Service or CHAPS to another bank account. This differs from unauthorised fraud, where a criminal steals bank details and makes transfers without your consent.

If you’ve been scammed:

  • Stop all contact with the fraudster immediately.
  • Report the scam to your Bank immediately and request a refund. The Bank may be able to stop or reverse the payment if it is to another UK Bank account.
  • Report the fraud to the police, usually via Action Fraud (the UK’s national reporting centre for cyber and financial crime).

Reporting to the police is important because:

  • It allows authorities a chance to trace the fraudster.
  • Your information could help prevent future scams.
  • Failing to report the scam when requested by your Bank can be grounds for the Bank refusing a refund of your stolen money.
  • You may also be referred to the National Economic Crime Victim Care Unit (NECVCU) for emotional support.
  • Your Bank must acknowledge your refund request within 15 days and give a full decision within 35 days. If they refuse the refund or only offer a partial amount, you can escalate your case to the Financial Ombudsman Service (FOS).

Why do Banks refuse APP scam refunds — and what can I do next?

Banks often refuse APP scam refunds for two key reasons:

  • They claim the customer was “grossly negligent” — for example, by ignoring a specific warning from the Bank that the transaction might be a scam.
  • The payment doesn’t qualify under APP refund rules, such as transfers to foreign accounts or debit card payments (credit card fraud is protected separately under the Consumer Credit Act).

If your claim is rejected, you can take your case to the Financial Ombudsman Service (FOS) — a free, independent body that can force your Bank to refund you if they find the Bank was at fault or didn’t apply the rules fairly.

You don’t need legal help to request a refund or appeal to FOS, but many people choose to work with a solicitor when:

  • The scam doesn’t clearly fall under the APP refund rules (e.g. a card payment or international transfer). Invariably, Banks decline these refunds but appeals can be made to FOS on the basis that the Bank should have done more to either prevent the transaction or stop or reverse it.
  • Victims are concerned their Bank will refuse the refund request and want their claim presented strongly from the start.
  • Their refund request has been rejected or reduced and they want to appeal with additional evidence.
  • The process feels overwhelming or too emotionally stressful to manage alone.

What information do I need to start a scam recovery claim?

To start a scam recovery claim, you’ll need to provide all available material evidence of what happened — both to your Bank and, if necessary, to the Financial Ombudsman Service (FOS).

When reporting the scam to your Bank (you may also request a refund at the same time), be prepared to share:

  • Details of the transaction(s) — such as bank statements showing the payments you made to the scammer.
  • Written communication with the scammer — including emails, text messages, or social media chats.
  • Any police report — particularly your Action Fraud or police crime reference number, if available.
