Ilott brought a legal challenge to the contents of the Will, arguing that it was unreasonable for her mother to make no financial provision for her future, especially given her financial circumstances.
In reaching their decision, the Court gave consideration to the importance of placing the needs of family members above those of other non-related beneficiaries.
The Court concluded that a reasonable financial provision should have been made for Ilott. This included a sufficient amount to enable her to purchase her property. After fully considering the facts, the Court awarded her £163,000.
