The UK Supreme Court has ruled that two overseas investment schemes are subject to UK financial regulations, including rules around marketing, risk warnings, and mis-selling protections.
Tim Wixted, director of Neglect Assist, told the Financial Times that this ruling highlights how unauthorised investment firms can face criminal charges if engaging in regulated activity without FCA approval.
Mr Wixted raised concerns about the widespread assumption that SIPP investments are always protected simply because the pension wrapper itself is regulated. He advises investors to check whether each underlying investment is also FCA-authorised.
This decision opens the door for mis-sold investors, including directors, business owners, and retirees, to pursue compensation for losses tied to unregulated schemes promoted under false pretences.
